actually.. the ones backing up always have the advantage.. since it is a RULE that the one who hit the car in front is always at fault..

of course, depends on the situation and unless you have a witness.. otherwise.. the other guy can say you hit him.. and if you show no prof that he backing up.. then its most likely be your fault!! since the collision is at your car front, and his car rear.
